MINUTES OF THE CIVIC CENTRE REDEVELOPMENT STEERING COMMITTEE OF ASHFIELD COUNCIL, HELD IN HABERFIELD LIBRARY, 78 DALHOUSIE STREET, HABERFIELD ON TUESDAY 19 OCTOBER 2010, COMMENCING AT 5:33 PM.

That the minutes of the Civic Centre Redevelopment Steering Committee Meeting held on Tuesday 21 September 2010 be confirmed.

 

      

Phase 1 Update

 

                             Update from Superintendent

§         Stephen Joannidis introduced and welcomed Oliver Crosse, ROC Construction, as the new Superintendent to the ACCRD

§         Oliver Crosse provided a verbal report.

§         Committee noted that:

-          Progress on site appears slow – an explanation has been requested of the Builder

-          The program in current form is unacceptable – a compliant program has been requested of the Builder

-          A fortnightly program has been requested of the builder.

-          Note the builder’s action in withdrawing Project Centre - Superintendent, Council, Architects and other parties have been locked out

 

Councillor Kennedy arrived at the meeting at 6:47pm

 

Report from Builder (Denhams)

Committee expressed concerns over numerous comments made by the builder in the report. Committee request that the Superintendent provide an advice with respect to these issues at the November meeting.

 

Report from the Architect

Larry Melocco, BHA provided a verbal update to the Committee.

Committee noted that:

-          Forecourt design works are complete and ready for construction, please refer to report

-          The architects have observed that construction appears to have slowed down over the last couple of weeks and resourcing levels appear low.

-          Key areas of construction do not appear to be progressing

-          Paperwork is extensive

-          BHA have requested review of their fees. Documentation in relation to this request has been sought

That Council resolves to:

 

1/3    Grant an exemption under LGA S55 (3), for the requirement to           tender for the   provision of a Specialist Contract/Claims           manager in regard to the Civic Centre Redevelopment contract.           Further, the General Manager is granted authority to negotiate           directly with Lefta with regard to the provision of such services.

 

2/3    Grant an exemption under LGA S55 (3), for the requirement to           tender for the provision of a Specialist Construction lawyer in           regard to the Civic Centre Redevelopment contract. Further, the           General Manager is granted authority to negotiate directly with           Herbert Geer with regard to the provision of such  services

 

     Further that Council :

 

3/3    Acknowledges that the selection and appointment of the           replacement Project Manager/Superintendent – ROC Projects           Pty Ltd - does not conform with Council’s internal Procurement           Policy. Further, the General Manager is   granted authority to           negotiate directly with ROC Projects with regard to the           provision of such services.

1/3    That Committee authorises the General Manager to act on Options 1 and 2 of the legal advice, as received

 

2/3    That the legal advice be treated as privileged information on the    grounds that information that would, if disclosed, prejudice the maintenance of law or that would otherwise be privileged from          production in legal proceedings on the ground of legal   professional privilege.

 

3/3    That the General Manager is authorised to approve procurement of a Clerk of Works to assist the Superintendent with the Project. 

 

The Mayor requested the minutes reflect that he voted against this motion.
